Any person who decides to appeal any decision of the City Council with respect to any
matter considered at this meeting will need a record of the proceedings, and for such
purpose, may need to ensure that a verbatim record of the proceedings is made, which
record includes the testimony and evidence upon which the appeal is to be based.
 
Applicants for land use and zoning related items are advised that the resumes of staff
members who prepare applicable staff reports are on file in the City Clerk's Office.
 
The City desires to accommodate persons with disabilities. Accordingly, any physically
handicapped person, pursuant to Chapter 286.26 Florida Statutes, should, at least 48 hours prior to the meeting, submit a written request to the chairperson that the physically handicapped person desires to attend the meeting.

A. Minutes - Approve the minutes of the regular City Council meetings on September 24, 2019 (6:30 p.m.) and October 8, 2019.

6. BOARDS AND COMMISSIONS
 
A. Student Advisory Council - Per Code of Ordinances, Section 2-53. - Removal of
Members, a memo from the Co-Chairperson is included in the agenda packet that notifies the City Council that the 12th grade representative from the North Brevard Home School Association automatically forfeited his seat, due to having missed three, consecutive, regular meetings on August 20th, September 17th, and October 15, 2019. This student however, would like to continue serving on the board and requests Council's consideration on this matter.
 
B. Historic Preservation Board - Appoint one alternate member to the Historic Preservation Board for an unexpired term that will expire on October 31, 2021.
 
C. Planning and Zoning Commission - Accept the resignation of Regular Member John Chambers with an unexpired term to expire on January 31, 2021. His resignation was effective on October 16, 2019. Appoint one regular member to an unexpired term to expire on January 31, 2021.
 
D. Municipal Code Enforcement Board - Appoint one (1) regular member to the Municipal Code Enforcement Board for a term to expire on October 31, 2022. Appoint two (2) alternate members to the Municipal Code Enforcement Board for unexpired terms to expire on October 31, 2020. In addition, staff is requesting Council appoint an additional regular member to the Municipal Code Enforcement Board for an unexpired term to expire on October 31, 2021 based on the appointments made for the Planning and Zoning Commission on the previous agenda item, if applicable.
 
E. North Brevard Library District Board - Accept the North Brevard Library District Board's Semi-Annual Report, as written.

A. Collective Bargaining Agreement between the Laborer's International Union of North America Local 630 and the City of Titusville - Approve the successor Collective Bargaining Agreement between the Laborer's International Union of North America Local 630 and the City of Titusville.
 
B. Acceptance of Award - Arbor Day 2020 Educational Material - Accept Arbor Day 2020 educational materials valued at $100.
 
C. Resolution No. 51-2019 Supporting Temporary Closure of State Roads - Max Brewer 5K Run and Rotary Chili Cook-Off - Adopt Resolution No. 51-2019 supporting temporary closure of a State Road for the Max Brewer 5K Run and Rotary Chili Cook-Off to be held on February 22, 2020.
 
D. Purchase of Fire Department Staff Vehicles - Authorize purchase of (2) 2020 Chevrolet Equinox vehicles, (1) 2020 Ford Transit T150 Cargo Van, and (1) 2020 Ford F150 Pick up truck to include associated emergency lighting and siren equipment from Alan Jay Fleet Sales for a total amount not to exceed $119,912.
 
E. Purchase of Police Vehicles - FY20 - Approve the use of Sourcewell Contract (formerly NJPA) Contract #2019-120716NAI for the purchase of six (6) 2020 Chevy Tahoe Police vehicles from Alan Jay Fleet Sales at $55,861.33 each for a total amount of $335,167.98; Four (4) 2020 Chevy Tahoe Police Sgt. Vehicles from Alan Jay Fleet Sales at $53,121.33 each for a total amount of $212,485.32; Three (3) 2020 Chevy Traverse Unmarked Vehicles from Alan Jay Fleet Sales at $46,740.00 each for a total amount $140,220.00; Two (2) 2020 Chevy Tahoe Police K9 vehicles from Alan Jay Fleet Sales at $59,316.33 each for a total amount of $118,632.66; Two (2) 2020 Chevy Traveres Civilian vehicles from Alan Jay Fleet Sales at $37,443.00 each for a total  amount of $74,886.00; One (1) 2019 Chevy Colorado Crew Cab Community Watch Vehicle from Alan Jay Fleet Sales at $29,195.33 for a total price of $29,195.33;  Purchase of four DSR 2X Stalker Radars from Sole Source Vendor Applied Concepts, Inc. (see attached Sole Source document) in the amount of $3,098.00 each for a total amount of $12,462.00; and Purchase of Eighteen (18) Radio Chargers and Eighteen (18) Power Adapter kits from Vendor of Record Communications International in the amount of $2,447.60. Total amount for Project Z02022 Police Vehicles FY20
$925,496.90.
 
F. Award of Water and Wastewater Treatment Chemicals - Approve the award of Brevard County Public Entity Purchasing Cooperative bid (B-20-01-COC) to Matheson Tri-Gas, Inc. of Irving, Texas in the amount of $19,200 for the acquisition of Carbon Dioxide; Allied Universal Corp. of Miami Florida in the amount of $140,836 for the acquisition of Sodium Hypochlorite; and Harcros Chemicals, Inc. of Tampa, Florida in the amount of $8,557 for the acquisition of Hydrofluosilicic Acid. In addition, authorize the inclusion of the awarded firms in the approved Vendor of Record List for Chemicals; and authorize the City Manager to issue purchase orders to acquire said chemicals on an as needed basis in accordance with the authorization permitted for Vendors of Record.
 
G. North Brevard County Hospital Interlocal Agreement regarding Occupation and Employee Health Services between the City of Titusville and Parrish Medical Center - Approve the Interlocal Agreement regarding Occupation and Employee Health Services between the City of Titusville and Parrish Medical Center.
 
H. Continuing Consultant Contract Award for RFQ #17-Q-30 Landscape Architect - Approve, subject to the resolution of the contract terms by the City Attorney and City Manager, the award of contract to the top ranked firm, Kimley-Horn and Associates, to provide Continuing Engineering Consultants services for Code 115: Landscape Architect for a three (3) year initial term with two (2) optional one (1) year extensions; and authorize the Mayor to execute the contracts.
 
I. Police Department Purchase of Mobile Radios FY20 - Approve the purchase of Mobile Radios not to exceed $93,568.00 from Communication International.
 
J. Continuing Consultant Contract Award for RFQ #17-Q-30 Traffic Engineering - Approve, subject to the resolution of the contract terms by the City Attorney and City Manager, the award of contract to the top two ranked firms, DRMP, Inc. of Melbourne, FL the number one ranked firm as the Primary consultant and Kimley-Horn and Associates, Inc. of Orlando, FL the number two ranked firm as the Secondary consultant, to provide Continuing Engineering Consultants services for Code 108: Traffic Engineering for a three (3) year initial term with two (2) optional one (1) year extensions; and authorize the Mayor to execute the contracts.
 
K. Approve Purchase of 150kW Portable Generator - Approve attached budget amendment, providing the necessary funding, and the purchase of a 150 kW portable generator from Tradewinds Power Corp. of Miami, Florida in the amount of $85,357 per the Florida Sheriff's Association Contract No. FSA18-VEH16.0, Spec #077, and authorize the City Manager to issue the purchase order necessary for this acquisition.
 
L. Advisability - Reclaimed Water Master Plan - Approve advisability for staff to engage one of the City’s continuing engineering services consultants to draft a Reclaimed Water Master Plan for both the North and South Areas of Critical Concern.
 
M. Purchase of Pac Set (portable) Radios - FY20 - Approve purchase of Pac Set (portable) Radios not to exceed $44,100.00, and authorize the City Manager to issue the purchase order necessary for this purchase.
 
N. Advisability - Building Trades Services in Planned Industrial Development (PID) Districts - Approve advisability for staff to review and make recommendations regarding building trades services in Planned Industrial Development (PID) districts.
 
O. Change Order #1 to Contract # CN19B057 with Affordable Development, Inc. for SR-405 Utilities Relocation Project - Approve Change Order #1 in the amount of $32,303.53 to contract # CN19B057 with Affordable Development, Inc. of Titusville, FL to furnish all material, labor, and equipment to install two (2) insertion valves and the associated components for the SR-405 Utility Relocation Project and authorize the City
Manager to execute the change order.

ANYONE WISHING TO SPEAK ON AN ITEM MUST FIRST COMPLETE AN AGENDA SIGN-UP CARD AND SIGN THE OATH CONTAINED THEREON. THOSE SPEAKING IN FAVOR OF A REQUEST WILL BE HEARD FIRST. A. Conditional Use Permit (CUP) Application No. 6-2019 - Elks Lodge - Approve CUP No. 6-2019 to allow a private club within existing units at the Titusville Mall located at 3550 S Washington Avenue with the following condition: (1) The private club use may occupy up to 5,000 square feet within the mall.
 
The Planning and Zoning Commission considered this request on November 6, 2019 and recommended approval as recommended with condition: (1) The private club use may occupy up to 5,000 square feet within the mall, 6-0.
 
10. ORDINANCES-FIRST READING
 
A. Ordinance No. 39-2019 Relating to Expiration of Conditional Use Permits After Issuance of a Building Permit - Conduct the first reading of Ordinance No. 39-2019 amending the Code of Ordinances to modify expiration dates for conditional use permits; by amending Section 34-77 “Revocation of conditional use permits”; providing for severability, repeal of conflicting ordinances, an effective date and incorporation into the code. (This is the first reading. The second reading and public hearing is scheduled for the regular City Council meeting on November 26, 2019 at 6:30 pm.)
 
The Planning and Zoning Commission reviewed this ordinance during their November 6, 2019 meeting and recommended tabling the item to their next meeting.
 
B. Ordinance No. 40-2019 Relating to Pervious Pavement - First Reading of Ordinance No. 40-2019 amending the Code of Ordinances by amending Chapter 30 “Development Options”, Section 30-276 “General design requirements” to permit the use of pervious pavement standards and credits citywide; providing for severability, repeal of conflicting ordinances, an effective date and incorporation into the code. (This is the first reading. The second reading and public hearing is scheduled for the regular City Council meeting on November 26, 2019 at 6:30 p.m.)
 
The Planning and Zoning Commission reviewed this ordinance during their November 6, 2019 meeting and recommended tabling the item to their next meeting.
 
C. Ordinance No. 41-2019 - Reinstatement of Deferred Retirement Option Plan (DROP) for General Employees - Approve First Reading Ordinance No. 41- 2019 An Ordinance of the City of Titusville, Florida, Amending Chapter 15, Pensions and Retirement, Article II, General Employees' Pension Plan, of the Code of Ordinances of the City of Titusville; Amending Section 15-105, Benefits Effective August 26, 2013"; Amending Section 15-110, Deferred Retirement Option Plan; Repealing All Ordinances In Conflict Herewith; Providing For Severability Of Provisions and Providing An Effective Date.
