matter considered at this meeting will need a record of the proceedings, and for such
purpose, may need to ensure that a verbatim record of the proceedings is made, which
record includes the testimony and evidence upon which the appeal is to be based.

Applicants for land use and zoning related items are advised that the resumes of staff
members who prepare applicable staff reports are on file in the City Clerk's Office.

The City desires to accommodate persons with disabilities. Accordingly, any physically
handicapped person, pursuant to Chapter 286.26 Florida Statutes, should, at least 48 hours prior to the meeting, submit a written request to the chairperson that the physically
handicapped person desires to attend the meeting.

A. Resolution No. 41-2019 Supporting Temporary Closure of State Roads - Jeeps & Jams, October Downtown Street Party, Friday Nite Live Salutes Veterans, December Downtown Street Party and Let It Snow - Adopt Resolution No. 41-2019 supporting temporary closure
of State Roads for five (5) downtown events.

B. Work Order for Engineering Services for the Armstrong pH Adjustment Improvements - Approve attached budget amendment, the creation of a new project WR1907 named Armstrong pH Adjustment, and the award of Work Order # AECOMWR004 to AECOM Technical Services, Inc. of Orlando, FL in the amount of $72,228 to provide engineering consulting services including, but not limited to, the preparation of a preliminary design report, permitting and project management of the Armstrong Booster Pump Station pH adjustment improvements, and authorize the Mayor to execute the Work Order.

C. Resolution No. 42-2019 Amending the Transportation Infrastructure Technical Manual By Correcting a Scrivener's Error - Adopt Resolution No. 42-2019 amending the Transportation Infrastructure Technical Manual to correct a scrivener's error.

D. Resolution No. 43-2019 Amending Community Development Fees - Adopt Resolution No. 43-2019 amending the Community Development Fees.

E. Change Order #1 to Contract # SV19B034 with In-Depth Inc., for Water Storage Tank Inspection and Cleaning Services - Approve Change Order# 1 in the amount of $19,950 to
Contract # SV19B034 with In-Depth Inc. of Ormond Beach, FL to include the removal of additional sediment encountered during cleaning and authorize the City Manager to execute the change order.

F. Award Bid for the Purchase and Installation of Knapheide Crane Body on Existing F550 Chassis - Approve award of Bid 19-B-048 for the purchase and installation of one (1) Knapheide Crane Body on an existing F550 Chassis from Knapheide Truck Equipment of
Orlando, Florida in the amount of $54,350.

G. Council Chamber Microphone System and Broadcast Control Room Cable - Approve the award of a contract for the replacement of Microphones and re-cabling of the control room to IM Solutions, 2801 South Harbor City Blvd, Melbourne, FL 32901, in the amount of $25,087.01, and authorize the City Manager to execute the contract.

H. Resolution No. 44-2019 - Adopt Resolution No. 44-2019 Supporting the Space Coast
EDC "Salutes our Military Campaign".

9. ORDINANCES – SECOND READING, PUBLIC HEARING AND RELATED ACTION

Second Reading, Public Hearing and Related Action (Quasi-judicial) THE FOLLOWING ITEMS ARE SUBJECT TO QUASI-JUDICIAL RULES OF PROCEDURE. ANYONE WISHING TO SPEAK ON AN ITEM MUST FIRST COMPLETE AN AGENDA SIGN-UP CARD AND SIGN THE  OATH CONTAINED THEREON. THOSE SPEAKING IN FAVOR OF A REQUEST WILL BE HEARD FIRST. IF YOU HAVE PHOTOGRAPHS, SKETCHES, OR DOCUMENTS THAT YOU DESIRE FOR CITY COUNCIL TO CONSIDER, THEY MUST BE SUBMITTED INTO EVIDENCE AND WILL BE RETAINED BY THE CITY. SUBMIT THESE EXHIBITS TO THE CITY CLERK.

A. Conditional Use Permit (CUP) 4-2019 - Orange Street Parking Lot - Conduct Public Hearing for Conditional Use Permit (CUP) No. 4-2019 to allow an off-site parking lot in the Urban Mixed Use (UMU) zoning district for vacant property located east of South Grannis Avenue, south of Orange Street and west of Robbins Avenue. (This item was tabled at the Regular City Council Meeting on July 23, 2019 (6:30 p.m.).

The Planning and Zoning Commission considered this request on July 17, 2019 and recommended approval with the condition that there be no overnight parking, 5-0.

B. Riverwalk Apartments Planned Development Rezoning (REZ) Application No. 1-2019 - Conduct the public hearing for Ordinance No. 25-2019 for Rezoning (REZ) Application No. 1-2019 amending Ordinance No. 7-2019, by amending the Master Plan and the conditions
of the Planned Development (PD) zoning district imposed for certain properties approximately 21.03 acres in size, having parcel ID numbers 22-35-26-00-504 and 22-35-26-00-518, located on the east side of U.S.. Highway 1, approximately one-half mile south of the intersection of U.S. Highway 1 and Riveredge Drive; and providing for an effective date.

The Planning and Zoning Commission (P&Z) considered this request on July 17, 2019 and recommended approval with the condition that the same 25-foot conservation easement language that was presented to the P&Z back on February 20, 2019 be included, 5-0. [Notes to Master Plan #2 - The twenty-five(25) foot wide undisturbed buffer along the east property line will be placed in a conservation easement, and #3 - In addition to the (25) foot undisturbed buffer in the conservation easement described in notes 1 and 2 above, there shall be an additional (25) landscape buffer on the west side of the (25) conservation easement. All specimen trees (twenty (20) inch dbh or greater) located within twenty-five (25) foot landscape buffer, will not be removed.]

C. Ordinance No. 26-2019 Regarding Community Engagement - Conduct the public hearing for Ordinance No. 26-2019 amending Chapter 34 “Procedures” of the Land Development
Regulations to establish community engagement requirements for specified development options, specifically amending Sections 34-22 “Required information/exhibits”, 34-39  “Submittals”, 34-55 “Master plan submittal”, and 34-395 “Procedure for application of Development Agreement”, and creating Section 34-13 “Community engagement”; providing for severability; repeal of conflicting ordinances; for an effective date and for incorporation into the code. 

The Planning and Zoning Commission considered this ordinance during their meeting on July 17, 2019 and recommended approval, 5-0.
