Section 1. Comprehensive Plan Amendment, Zoning / Rezoning, Conditional Use Permits, Development Review Committee & Master Plan Fees.

Section 2. Land Development Fees

  1. If additional reviews beyond the initial three are required, the applicant must submit an additional fifty (50)% of original review fee.

Section 3. Site Development Permit Fees

A permit fee of all improvements required by Chapter 34, Procedures, Article IV Site Plans shall be paid to defray the cost of inspection by the City.

*A surcharge shall be assessed on each permit fee in the amount of 0.3 mil per dollar valuation. The fee is to be charged on all permits regardless of type, rounded to the nearest cent including fees required under this chapter and the provisions of the Land Development Regulations. The funds generated by the surcharge shall be used exclusively for the training of department personnel and the purchase of technological tools and equipment for the department.

Section 5. Board of Adjustment & Appeals Fees

  1. Appeals from decision of an administrative official: $ 475 plus legal advertisement fee.
    (Should the Board sustain the appeal, $ 475 fee and advertisement fee is refunded.)
  2. Variances:
    1. Single-family, multifamily zoning districts and non-profit organization properties: $265 plus legal advertisement fee.
    2. All commercial, industrial, mixed use and any other district/uses not listed in subsection (b)(1) above: $525 plus legal advertisement fee.
    3. Subsequent items processed at the same time as the first item: $100 per additional request.
  3. Public Purpose Variances: $525 plus legal advertisement fee.

Section 6. Development Agreement / Vested Rights Application / Beneficial Use Determination / Transfer of Development Rights / Administrative Waiver.

  1. Development Agreement $1,575 plus $8 per dwelling unit/1,000 square feet nonresidential plus legal advertisement cost.
  2. Vested Rights Application $1,575 plus $8 per dwelling unit/1,000 square feet nonresidential plus legal advertisement cost.
  3. Beneficial Use Determination $1,575 plus $8 per dwelling unit/1,000 square feet nonresidential plus legal advertisement cost.
  4. Transfer of Development Rights $475 plus $8 per dwelling unit.
  5. Administrative Waiver of Setbacks/Minimum Lot Size $105

Section 7. Vacating Rights-of-Way & Easements/Street Renaming.

  1. Vacating and Abandoning Rights-of-Way (ROWs) Streets and Alleys: $935 plus legal advertisement cost.
  2. Vacating Easement: $935 plus legal advertisement cost.
  3. Street Renaming: $630

Section 8. Concurrency Review / Zoning Confirmation Letter.

  1. Independent general update on capacities $55

Section 9. Fee Refund/Waiver Policy 

Requests for fee refunds or waivers shall be provided to the City Manager or designee in writing, and the request shall be evaluated based upon the following criteria:

  1. Advertising fees will be refunded if an application is withdrawn in writing prior to the City submitting the advertisement to the newspaper.
  2. With the exception of building permit fees and advertising fees, waivers may be approved by the City Manager or designee for public projects or affordable housing projects.
  3. The City Manager may waive fees during declared emergencies, for projects or situations related to the said emergency.
  4. The City Manager may waive all or a portion of a fee, if the fee is the result of staff error.
  5. The City Manager or designee may waive the double building permit fee when justifiable cause has been demonstrated in writing.
