The Planning and Zoning Commission (P&Z) of the City of Titusville, Florida met in regular session in City Hall Council Chamber located at 555 South Washington Avenue on Wednesday January 17, 2024 at 6:00 p.m.

Chairman Richardson called the meeting to order at 6:00 p.m. Present were Vice Chairman Aton, Member Garrod, Member Perez, Member Moscoso, Member Fayson, Alternate Member Rogers and Alternate Member Childs. Secretary Grant and School Board Member Gilbert were absent. Also, in attendance were Principle Planner Eddy Galindo, Senior Planner Christie Anderson, Assistant City Attorney Chelsea Farrell and Recording Secretary Laurie Dargie.

Member Perez made a motion to approve the minutes from the January 3, 2024 meeting as presented. Vice Chairman Aton seconded. There was a unanimous voice vote.

Old Business

 

Landscape Technical Manual Ordinance

Mr. Galindo informed the Planning and Zoning Commission that the consultant with Kimley-Horn did not provide the updated list to staff in time to present the updated list as per the Titusville Environmental Commission’s recommendation.

 

The Planning and Zoning Commission felt that they were unable to make a recommendation on the list if they did not have the opportunity to review the actual species that were going to be recommended on the list.

 

Kay St. Onge of Titusville came to speak about the technical manual tree list and suggested that the Planning and Zoning Commission wait to make any recommendations until they see the actual list of species being recommended.

 

Kimberly Gibbs of Merritt Island spoke about how important it is to use all Florida native plantings if possible, even over Florida friendly species.

 

Michael Myjak of Titusville said that the Titusville Environmental Commission proposed using only Florida native species in the past and would still prefer to only use Florida native species. Mr. Myjak also said that he would like for the Tree Mitigation Trust Fund to be used for Florida native plantings and would suggest that this be something that City Council consider.

 

Member Moscoso asked Mr. Galindo how the Tree Mitigation Trust Funds could be allocated to Florida native plantings. Mr. Galindo said that the Planning and Zoning Commission can make a recommendation to City Council regarding this if they so desire.

 

Chairman Richardson asked staff why the list was not updated by Kimley-Horn as promised by them at the Titusville Environmental Commission meeting. Mr. Galindo said that Kimley-Horn provided an additional cost for the scope of work to update the list and that staff would need to have this approved by City Council as it is an additional $8,500.00. 

 

The Planning and Zoning Commission had discussion regarding not using the consultant Kimley-Horn for any additional work on this tree list and having the Titusville Environmental Commission be the ones who update the tree list and provide back to the Planning and Zoning Commission for review before sending it to City Council. The Planning and Zoning Commission also spoke about incorporating incentives and or minimum requirements for native plantings.

Member Garrod made a motion to table this item for ninety days (90) to allow time for the Titusville Environmental Commission to create the list of species for the Tree Technical Manual Ordinance.   Member Rogers seconded.

Member Rogers made a motion to recommend to City Council that they give advisability to the Titusville Environmental Commission to look into making the Tree Technical Manual Ordinance both mandatory and or incentivized with the majority of plantings being Florida native species. Member Fayson seconded.

Comprehensive Plan Amendments to the Future Land Use Element, Transportation & Housing Elements, and Draft Land Development Regulations

Mr. Galindo gave an overview of this item.

 

Member Garrod made several comments regarding different policies, strategies and objectives in the draft land development regulations. Mr. Garrod asked if this would be coming back before the Planning and Zoning Commission for review and recommendations. Mr. Galindo said yes, and explained that what is before the Planning and  Zoning Commission tonight was to get approval to send the document to the State for their review and comments and it would be brought back to the Planning and Zoning Commission for their review, recommended changes, and feedback before being adopted.

 

Toni Shifalo of Titusville came to share her displeasure with using the consultant Kimley-Horn for any consulting needs in the City of Titusville.

Member Garrod made a motion to recommend transmittal of this document to the State as presented. Vice Chairman Aton seconded. 

 

Member Rogers requested a friendly amendment that the comment made by Member Garrod regarding policy 1.24.3.2 be included as a recommended change for having height be addressed in feet rather than stories. Assistant City Attorney Farrell said that a specific feet requirement should be suggested. Member Rogers was unsure of what the height in feet should be. Member Garrod reiterated that since this will be coming back before the Planning and Zoning Commission for review and recommendations, he would suggest that this friendly amendment not be accepted in order to allow the specific details and language be specified when there is more time to review it in depth to determine the details for the Comprehensive Plan.

 

Member Moscoso said she would like this change to be included now and not later.

Petitions & Requests

 

Dwight Severs of Titusville came to speak. Mr. Severs provided a multi-page handout to the Planning and Zoning Commission members and staff.  Mr. Severs spoke about his displeasure with the Brookshire subdivision development. Mr. Severs spoke about the concerns with current flooding and concerns with increased flooding as the project progresses.  Mr. Severs suggested that the Planning and Zoning Commission request that the procedures for reviewing preliminary plat sketches be changed to include the Planning and Zoning Commission so that they have an opportunity to review these sketches as part of the review process instead of allowing it to be only administratively reviewed. Mr. Severs said he would ask that the Planning and Zoning Commission request City Council to look into the flooding concerns of the Brookshire development and also that adjacent property owners be provided notification of developments that are taking place so that they have an opportunity to provide their input. Mr. Severs would like also for the process for preliminary plats to be reviewed for procedural changes.

Member Moscoso made a motion requesting staff to bring back more information on the Brookshire development for discussion at a future meeting. Member Perez seconded. There was a unanimous voice vote in favor.

Toni Shifalo of Titusville came to speak about the clear cutting on Brookshire development, the complaints by the neighboring communities and the displaced wildlife.

 

Kay St. Onge of Titusville came to speak about the Brookshire development and the need to stop clear cutting of trees and also stop vegetation from being burned on site and the displaced wildlife.

Reports

 

Chairman Richardson said that the Council Chamber is still not ADA compliant and he will be addressing City Council about this.

 

Chairman Richardson said that it was mentioned at the City Council meeting that Tallahassee is looking to make changes to the Live Local Act. 

 

Member Moscoso said that there is an online training opportunity for the Planning and Zoning Commission on January 25th and 26th.

 

Member Perez announced to the Planning and Zoning Commission members that he requested not to be reappointed to the Planning and Zoning Commission.  He said he has appreciated the opportunity to serve with the fellow Commission members. The members of Planning and Zoning Commission thanked Member Perez for his service on the Commission.

 

Chairman Richardson said that this will open a vacancy on the Planning and Zoning Commission and also the opportunity for a dual member to serve on both the Planning and Zoning Commission and the Titusville Environmental Commission if desired.

 

Mr. Galindo said that if anyone desires to serve on the Titusville Environmental Commission as the dual member that they will need to fill out the application with the City Clerk’s office.
