The Planning and Zoning Commission (P&Z) of the City of Titusville, Florida met in regular session in City Hall Council Chamber located at 555 South Washington Avenue on Wednesday October 18, 2023 at 6:00 p.m.

Chairman Richardson called the meeting to order at 6:00 p.m. Present were Vice Chairman Aton, Secretary Grant, Member Moscoso, Member Perez, Alternate Member Childs and Alternate Member Rogers. Member Fayson, Member Garrod and School Board Member Gilbert were absent. Also, in attendance were Principal Planner Eddy Galindo,  Assistant City Attorney Chelsea Farrell  and Recording Secretary Laurie Dargie.

Secretary Grant made a motion to approve the minutes from the October 4, 2023 meetings. Vice Chairman Aton seconded. There was a unanimous voice vote.

Accessory Dwelling Units Draft Ordinance

The Planning and Zoning Commission had discussion regarding Section 28-351 C 1 (E) and (I).

Stan Johnston of Titusville came to speak regarding rule thirteen and gave a piece of paper that said Prop 13.

Vice Chairman Aton made a motion to recommend approval of the Accessory Dwelling Units Ordinance as presented and with the change to Section 28-351 C 1 (E) to have a minimum of 300 square feet and a maximum of 950 square feet, the 35% stays the same.  Member Rogers seconded.

Chairman Richardson asked that the Commission discuss the Live Local Act Ordinance and Resolution before the petitions and requests. The Commission agreed to discuss it before petitions and requests.

Live Local Act Ordinance & Resolution

Chairman Richardson spoke about conversations he has over the phone with other municipalities regarding the Live Local Act.  Chairman Richardson said that he feels that there is no sense in drafting an ordinance that may conflict with state statute. 

Member Moscoso said she spoke to someone with the City of Melbourne and they passed an ordinance and she feels that it is good ordinance for the Commission to review. Member Moscoso provided a copy of the Melbourne, Florida ordinance to each of the Commission members.

The Planning and Zoning Commission had discussion.

Member Moscoso and Member Rogers do not feel that the airport should be included in the 20%. 

Member Moscoso would like for the Commercial and Industrial to be protected.

Jeremy Gibson of Titusville came to speak against this item.

Lindsey Grizzle of Titusville came to speak against this item. Ms. Grizzle provided a handout to the Planning and Zoning Commission members.

Member Moscoso insisted on a staff member to read from her Comprehensive Plan book, Policy 1.14.6. Assistant City Attorney Farrell read Comprehensive Plan Policy 1.14.6.

Petitions & Requests

Connie Milton of Titusville asked the Planning and Zoning Commission to find out if the airport is included in the 20%.

Billy Jo Clayton of Titusville spoke about the Apollo Gardens development and her concerns with the entrance and exits and also the accessibility of emergency vehicles. 

Stan Johnston of Titusville came to speak about the inaccurate survey for SNJ Oaks. Mr. Johnston provided a small handout.

Chris Hylton of Titusville asked city staff if the roads that will be used for the Apollo Garden project are arterial or collector roads.  Mr. Galindo stated that it is Demaret Drive which is not an arterial or collector road. Mr. Hylton asked how Comprehensive Plan Policy 1.14.6 applies to the Apollo Gardens development. Mr. Galindo stated that this is in litigation and he is unable to discuss. 

Assistant City Attorney Farrell confirmed that this is in litigation and cannot be discussed at this time.

Reports

Chairman Richardson reminded the Planning and Zoning Commission members that the Boards & Commission recognition dinner is on October 26, 2023.

Chairman Richardson asked if Mr. Galindo would remind Mr. Parrish to provide information regarding the educational training in Deland on November 3, 2023.

Chairman Richardson wanted to thank Public Works Director Kevin Cook for making sure that the lights in the parking lot at City Hall were lit up.
