The Board of Adjustments and Appeals (BAA) of the City of Titusville, Florida, met in regular session in Council Chambers, on Wednesday, April 27, 2022.

Chairman Taylor called the meeting to order at 6:00 p.m. and asked the assembly to recite the Pledge of Allegiance to the Flag.

Present were Chairman Thomas Taylor, Vice-Chairman Kristin Smith-Rodriguez, Member Margaret Van Deven, Member Richard Wheelus and Alternate Member David Mandernack virtually. Also, in attendance were Planning Manager Brad Parrish, Assistant City Attorney Chelsea Farrell and Development Specialist Kim Amick. It was determined that a quorum was present.

Vice-Chairman Smith-Rodriguez made a motion to approve the minutes for March 23, 2022. Member Wheelus seconded. All in attendance voted to approve the minutes.

Chairman Taylor confirmed the quasi-judicial procedures verifying that all persons wishing to speak before the board has signed an oath card.

Brad Parrish confirmed that all agenda items had been properly advertised.
Chairman Taylor called for members’ statements, if they had visited any of the sites.

Variance 11-2022 – 1784 Crossbill Drive
Brad Parrish stated this item is not an advertised public hearing, this is a request for the board to consider allowing this application to be heard again. At the last meeting this application was considered by the Board and was denied per Section 34-261(a) of the Code, any applicant whose request for a variance is denied may apply for a rehearing of the Codes. A request for a rehearing was submitted by the applicant to the City on April 7, by the deadline. Casey Grenville is the applicant and he submitted a letter, according to the code requirements. Mr. Parrish read into the record the requirements.
Discussion followed.
Member Wheelus made a motion to rehear the item, Variance 11-2022, 1784 Crossbill Drive.

Variance 13-2022 – 4244 S Washington Avenue
Brad Parrish reviewed the staff report and explained what the applicant was requesting.
Sid Chehayeb, 3650 Bobbi Lane, Titusville, spoke in favor.
John Batts, 205 Knox Mc Rae Drive, Titusville, spoke against.
Jeanne Forte, 4370 Mt. Vernon Avenue, Titusville, spoke in favor.
Vice-Chairman Smith-Rodriguez regarding Variance 13-2022, made a motion to eliminate the building perimeter landscaping on the east and south sides of the building on the condition that shrubs be planted on the south side of the sidewalk, on the south side of the building.
Mr. Parrish stated his understanding of the motion is you are making a motion to approve number two and three on page 66 with the conditions they recommended.
Vice-Chairman Smith-Rodriguez stated yes. She stated she put them together because they are both eliminating a building perimeter on two sides.

Vice-Chairman Smith-Rodriguez with regard to Variance 13-2020, made a motion to deny the request to eliminate the building perimeter on the west side of the building.

Vice-Chairman Smith-Rodriguez regarding Variance 13-2022, made a motion to approve the perimeter landscape yard buffers on the north boundary of five feet, east and south side of the property, 10 feet, on the condition that all required vegetation be planted per the Code, including overstory and understory trees and shrubs.
