The Planning and Zoning Commission (P&Z) of the City of Titusville, Florida met in regular session in a Fire Station 11, in the Fire Department Multi-Purpose Room located at 550 South Washington Avenue on Wednesday January 19, 2022 at 6:00 p.m.

Chairwoman Speidel called the meeting to order at 6:00 p.m. Present were Vice Chairman Richardson, Secretary Grant, Member Rice, Member Aton, Alternate Member Childs and Alternate Member Fayson. Member Porter and Member Riley requested to attend virtually but due to technical difficulties the City was unable to accommodate the virtual setup. Also in attendance were Planning Manager Brad Parrish, Assistant City Attorney Chelsea Farrell and Recording Secretary Laurie Dargie.

Vice Chairman Richardson made a motion to approve the minutes from the January 5, 2022 as presented. Member Aton seconded. There was a unanimous voice vote.

Tree Survey Ordinance
Mr. Parrish gave an overview of this item.
Mr. Parrish clarified all of the Titusville Environmental Commission’s recommendations one at a time. Mr. Parrish stated that on the fifth recommendation, it was intended for the recommendation to read remove all of (2) A, B, C D and “E” to be included as E 1,2,3,4.
Toni Shifalo of 715 Tropic Street Titusville, Florida came to speak neither for nor against this item.
Alternate Member Fayson arrived to the meeting at 6:13pm.
Mary Sphar of 825 Clifton Cove Court Cocoa, Florida came to speak neither for nor against this item.
Member Rice stated that the Titusville Environmental Commission intended to make a motion that would include stating to remove all staff recommendations from the Technical Manual except for a reference to see Section 30-40 of the ordinance. Member Rice said a motion was not made but this was discussed and was the desire of the Titusville Environmental Commission.

Member Childs made a motion to approve the tree survey ordinance with the following Titusville Environmental Commission recommendations with changes to Section 30-40. Restore number 1 in Section (C) as it was, change number 2 in Section (C) to say For all sites the applicant shall provide the following: In Section (C) 2 A. at the end of the first sentence add after the word “greater” in the development area. In Section (C) 2 A in the second sentence change the words “tree survey” to tree count by species and size six-inch dbh and greater. Also, remove all of (2) A,B,C,D and E 1,2,3,4. This motion also includes a recommendation to replace staff’s recommendations in the Technical Manual with a reference in the Technical Manual to see Section 30-40 of the ordinance. Vice Chairman Richardson seconded.

Petitions & Request from Public Present
Mary Sphar of 825 Clifton Cove Court Cocoa, Florida came to speak. Ms. Sphar spoke on supporting city staff’s recommendation to delete all of Section (C) (1) in Section 30-40 and explained the reasons why using page 61 of the agenda “Incentives (1) and also the need to remove staff’s recommendations in the technical manual, except for a reference to Section 30-40 of the ordinance.
Discussion took place amongst the Planning and Zoning Commission members, staff and Ms. Sphar.

Member Childs made a motion to request that City Council investigate the ramifications of keeping or deleting Section 30-40 (C) (1). Member Fayson seconded.

Motion passed 6 yes, 1 no vote.
Chairwoman Speidel voted no because she does not feel that the Planning and Zoning Commission should be asking City Council to investigate because the Planning and Zoning Commission should be doing the investigating and providing the recommendations to them.

Vice Chairman Richardson stated that he feels this ordinance is too complicated and it should be simplified so that anyone can understand it.

Reports
Member Grant said he received a phone call from Ms. Campbell in the City Clerk’s office regarding his term with the Planning and Zoning Commission expiring this month. Member Grant informed Ms. Campbell of his desire to continue serving on the Planning and Zoning Commission and that he would be able to attend the January 25, 2022 City Council meeting, however he is unable to attend the City Council meeting and wanted to express his desire to the Planning and Zoning Commission that he would like to continue serving if City Council approves his reappointment.
