MUNICIPAL CODE ENFORCEMENT BOARD MINUTES

The Municipal Code Enforcement Board held its regular meeting at 2:00 p.m. in the Council Chamber, second floor of City Hall, 555 S. Washington Avenue, Titusville, Florida.

Members present: Chairman Mike Cunningham, Vice Chairman Pat Bell, Member Jean Hillock, Member Gina Beckles, Member Edward Moniz, Member Erica Myers and Alternate Board Member Joseph Richardson.
 
Members absent: Member Darrell Barrett and Alternate Board Member Romie Grant
 
City Staff present were: Officer Bob Crisco and Code Enforcement Manager Glenn Tolleson, Building Plans Manager Steve Adams.  Also present were Assistant City Attorney Chelsea Farrell and Board Attorney Rick Rogers.

The meeting was called to order at 2:00 p.m. The entire assembly recited the Pledge of Allegiance to the Flag.

Vice Chairman Bell made a motion for approval of the July 11, 2016 minutes. Member Hillock seconded. Motion carried by unanimous voice vote.

VII.     Old Business
 
Case #13-49 Northwood Investments LLC – 3800-3810 S Washington Avenue
Code Manager Tolleson advised the Board that the owners have submitted a new site plan to the City.  The City has provided comments to the owner and the owner expects to respond to the comments by the end of the month.
 
Vice Chairman Bell made a motion to continue Case #13-49 until the September 12, 2016 Board meeting.  Member Hillock seconded.  Motion carried by unanimous voice vote. 
 
Case #16-82 Gregory E Shaw & Deborah Denise Shaw – 2910 St Mark’s Drive
Officer Crisco testified he inspected the property on February 12, 2014 and found the violation of Section 6-56 Permit Required to exist.  Officer Crisco testified a total of five permits were required for work done at the property.  Officer Crisco testified the permits were applied for on March 5, 2014 but were never issued.  Assistant City Attorney Farrell submitted emails from the Building Plans Manager regarding the permits needed for the property to the Board for review.
 
Building Plans Manager Steve Adams testified permits were needed for a driveway extension, a carport, a storage building, a fence and a screen room enclosure.  Building Plans Manager Adams advised the necessary permits were applied for on August 5, 2016.  Building Plans Manager Adams testified the cost of the permits is $900.94.  Building Plans Manager Adams advised more information was needed from the property owner before permits can be issued.
 
Assistant City Attorney Farrell submitted the Notice of Violation and Affidavit of Posting as Exhibit #1.  Officer Crisco testified that he re-inspected the property on August 8, 2016 and the property was still in violation.  Assistant City Attorney Farrell submitted three photographs of the property taken February 12, 2014 and one photograph of the property taken July 28, 2016 as Exhibit #2.  Assistant City Attorney Farrell submitted the Notice of Hearing and Complaint and Affidavit of Posting as Exhibit #3.  Assistant City Attorney Farrell submitted the Cost Recovery Sheet in the amount of $446.97 as Exhibit #4.
 
Gregory Shaw, Property Owner, testified that he applied for the permits and thought that someone from the City was supposed to contact him after he applied for the permits.  Mr. Shaw testified that he didn’t hear anything back from the City since January of 2016 and he has since re-applied for the necessary permits since the previous applications have expired. 
 
Member Moniz made a motion to continue Case #16-82 until the September 12, 2016 Board meeting.  Member Hillock seconded.  Member Beckles abstained from voting.  Motion carried by unanimous voice vote.
 
Case #16-90 Silverbreeze MHP LLC – 925 Cheney Highway, Lot 26
Officer Crisco testified he inspected on July 19, 2016 and found the violations of Section 6-109 Property Maintenance Sub Section 110.1; Demolition, Sub Section 109.1; Imminent Danger, Sub Section 108.1; Unsafe Structure, Sub Section 108.1.3; Structure Unfit for Human Occupancy, Sub Section 108.1.5; Dangerous Structure or Premises, and Sub Section 110.3; Failure to Comply to exist.  Assistant City Attorney Farrell submitted the Notice of Violation and Affidavit of Posting as Exhibit #1.  Officer Crisco testified that he re-inspected the property on July 26, 2016 and the property was still in violation.  Assistant City Attorney Farrell submitted one photograph of the property taken July 19, 2016, one photograph of the property taken July 20, 2016, one photograph of the property taken July 26, 2016, six photographs of the property taken July 29, 2016 and one photograph of the property taken August 8, 2016 as Exhibit #2.  Assistant City Attorney Farrell submitted the Notice of Hearing and Complaint and Affidavit of Posting as Exhibit #3.  Assistant City Attorney Farrell submitted the Cost Recovery Sheet in the amount of $411.75 as Exhibit #4.
 
Lisa Demar, Property Owner, testified she was on vacation from July 15, 2016 through July 29, 2016.  Ms. Demar testified that while she was away on vacation she learned the mobile home caught on fire and Ms. Demar instructed a resident Zoltan F Nagy to tape the property off and put a notice on it that no one was allowed to enter the property.  Ms. Demar testified that she is not the owner of the mobile home and that an Eric Patterson was the owner.  Ms. Demar stated she attempted to contact Code Enforcement several times and left several messages but never received a call back.  Ms. Demar testified that she also never received any notices from Code Enforcement in the mail. 
 
Zoltan Frank Nagy, testified that the property is taped off 8 feet around the mobile home so that if the trailer falls there is enough of a barrier to protect people.  Mr. Nagy testified that he has spoken to Eric Patterson several times and asked him to sign the property over to the mobile home park.  Mr. Nagy testified that Mr. Patterson has stated several times Mr. Patterson does not want anyone touching his mobile home or his property inside. 
 
Ms. Demar requested a 7 day extension from the Board to remove the mobile home.
 
Mr. Nagy testified they would need more than 7 days to remove the mobile home. 
 
Ms. Demar testified she owns the land that the mobile home is on and has a lot rental agreement with Mr. Patterson.
 
Member Moniz made a motion that the Board issue the following Finding of Fact in Case # 16-90, relating to the Defendant, Silverbreeze MHP LLC:
  1. That the Defendant was properly notified of the violations as alleged in the complaint.
  2. The Defendant is the owner of, or in possession of, the real property located at 925 Cheney Hwy, lot 26, Titusville, Florida.
  3. The Defendant is in violation of all of the Sections of Code, as indicated in the compliant.
    Member Hillock seconded.  Motion carried by unanimous voice vote. 
 
Member Moniz made a Motion that the Board issue its Order to Correct relating to the Defendant, Silverbreeze MHP LLC:
  1. Adjudging the Defendant to be in violation of the Section of the Code of Ordinances of the City of Titusville as determined in the Findings of Fact.
  2. Giving the Defendant until 12 noon on September 9, 2016 to correct the violation to the written satisfaction of the Code Enforcement Officer or to appear before this Board at City Hall, Titusville, Florida on September 12, 2016 to show cause why the violation(s) have not been corrected and why this Board should not proceed to impose a fine for the violation(s).
  3. The Board reserves jurisdiction to determine the costs incurred by the City of Titusville.
Member Hillock seconded.  Motion carried by unanimous voice vote.
 
Case #16-35 Sarah F Johnson Estate – 527 Rock Pit Road
Assistant City Attorney Farrell advised the Board that this case is being withdrawn due to compliance. 
 
Case #15-45 Donna J Crannell & Bobbye L Lewis – 1103 English Street
Assistant City Attorney Farrell advised the Board that the Board previously continued this case since August of 2015.  Assistant City Attorney Farrell advised the Board that the property went before a judge and a writ of possession was issued for the property however, the writ has not been served by the sheriff yet.
 
Officer Crisco testified he re-inspected the property on August 8, 2016 and the property was still in violation of Section 6-109 Property Maintenance Sub Section 102.2 Maintenance – Occupied with No Active Water.  Officer Crisco testified he spoke to the occupants during his inspection and they said they were just waiting to get evicted to leave.  Officer Crisco reviewed 1 photograph of the property taken on August 8, 2016 with the Board.
 
Member Beckles made a motion that the Board issue the following Finding of Fact in Case # 15-45, relating to the Defendant, Donna J Crannell & Bobbye L Lewis:
  1. That the Defendant continued to be in violation of the following Section(s) of the Code of Ordinances of the City of Titusville on August 8, 2016 as previously determined by this Board.
Member Moniz seconded.  Motion carried by unanimous voice vote.
 
Member Beckles made a motion that the Board issue its Final Judgment Assessing Fine and Imposing Lien relating to the Defendant, Donna J Crannell & Bobbye L Lewis, based upon the Findings of Fact issued this date, and that the Judgment contain the following provisions:
  1. The defendant is assessed and ordered to pay a fine of $250 per day for the violation of 6-109 Property Maintenance Sub Section 102.2 Maintenance – Occupied with No Active Water, as set forth in the Findings of Fact herein.
  2. The fine shall commence on August 29, 2016 and shall continue until the Code Violation has been corrected to the written satisfaction of the Code Enforcement Officer.

Assistant City Attorney Farrell advised the Board the City would like to continue this case until the September 12, 2016 Board meeting.

Case #16-66 James B Mc Gowen – 1205 La Brea Avenue
Assistant City Attorney Farrell advised the Board this case is being withdrawn and the owner is being recited.
 
 
Case #16-69 Bonnie L Dodd – 4415 Barna Avenue
Assistant City Attorney Farrell advised the Board this case is being withdrawn due to compliance.
 
Case #16-72 Global Strip LLC – Tax Id 2213403 S Washington Avenue
Assistant City Attorney Farrell advised the Board the City would like to continue this case until the September 12, 2016 Board meeting.

Assistant City Attorney Farrell advised the Board this case is being withdrawn due to compliance.
 
Case #16-75 Eleanor Shoman – 919 Pine Street
Assistant City Attorney Farrell advised the Board this case is being withdrawn due to compliance.
 
Case #16-76 Freddie May Hampton – 932 S De Leon Avenue
Assistant City Attorney Farrell advised the Board the City would like to continue this case until the September 12, 2016 Board meeting.

Assistant City Attorney Farrell advised the Board this case is being withdrawn due to compliance.
 
Case #16-78 Jennie Hester Estate C/O Rosaline Hester – 909 Pine Street
Officer Crisco testified he inspected the property on May 25, 2016 and found the violations of Section 12-23 Junk & Debris, Section 13-26 Overgrowth, and Section 12-26 Camping to exist.  Officer Crisco reviewed a map from the Brevard County Property Appraisers Office of 909 Pine Street and 515 S De Leon Avenue with the Board.  City Attorney Farrell submitted the Notice of Violation and Affidavit of Posting as Exhibit #1.  Officer Crisco testified that he re-inspected the property on August 8, 2016 and the property was still in violation.  Assistant City Attorney Farrell submitted three photographs of the property taken July 28, 2016 and three photographs of the property taken August 8, 2016 as Exhibit #2.  Assistant City Attorney Farrell submitted the Notice of Hearing and Complaint and Affidavit of Posting as Exhibit #3.  Assistant City Attorney Farrell submitted the Cost Recovery Sheet in the amount of $446.97 as Exhibit #4.
 
Officer Crisco testified he spoke Rosaline Hester on June 9, 2016 and attempted to get a trespass warning for the property but Mrs. Hester stated those were her relatives at the property.
Member Beckles made a motion that the Board issue the following Finding of Fact in Case # 16-78, relating to the Defendant, Jennie Hester Estate C/O Rosaline Hester:
  1. That the Defendant was properly notified of the violations as alleged in the complaint.
  2. The Defendant is the owner of, or in possession of, the real property located at 909 Pine Street, Titusville, Florida.
  3. The Defendant is in violation of the following provisions of the Code of Ordinances of the City of Titusville:

Member Beckles made a Motion that the Board issue its Order to Correct relating to the Defendant, Jennie Hester Estate C/O Rosaline Hester:

Case #16-79 Richard E Bakula & I Lousie Bakula C/O Barbara Whitley – 515 S De Leon Avenue

  2. The Defendant is the owner of, or in possession of, the real property located at 515 S De Leon Avenue, Titusville, Florida.
  3. The Defendant is in violation of the following provisions of the Code of Ordinances of the City of Titusville:

  2. Officer Crisco testified he inspected the property on May 6, 2016 and found the violation of Section 13-73 Inoperable Vehicles Prohibited to exist.  City Attorney Farrell submitted the Notice of Violation and Affidavit of Posting as Exhibit #1.  Officer Crisco testified that he re-inspected the property on August 8, 2016 and the property was still in violation.  Assistant City Attorney Farrell submitted two photographs of the property taken July 28, 2016 and three photographs of the property taken August 8, 2016 as Exhibit #2.  Assistant City Attorney Farrell submitted the Notice of Hearing and Complaint and Affidavit of Posting as Exhibit #3.  Assistant City Attorney Farrell submitted the Cost Recovery Sheet in the amount of $446.97 as Exhibit #4.
 
Member Myers made a motion that the Board issue the following Finding of Fact in Case # 16-70, relating to the Defendant, Phillip M Kirkland:
  1. That the Defendant was properly notified of the violation as alleged in the complaint.
  2. The Defendant is the owner of, or in possession of, the real property located at 4760 Winchester Drive, Titusville, Florida.
  3. The Defendant is in violation of the following provision of the Code of Ordinances of the City of Titusville:

Officer Crisco testified he inspected the property on June 7, 2016 and found the violations of Section 13-26 Overgrowth, Section 6-109 Property Maintenance Sub Section 301.3 Vacant Structure and Land, Sub Section 302.7 Accessory Structures and Sub Section 304.13 Windows, Skylight to exist.  City Attorney Farrell submitted the Notice of Violation and Affidavit of Posting as Exhibit #1.  Officer Crisco testified that he re-inspected the property on August 8, 2016 and the property was still in violation.  Assistant City Attorney Farrell submitted two photographs of the property taken August 8, 2016 as Exhibit #2.  Assistant City Attorney Farrell submitted the Notice of Hearing and Complaint and Affidavit of Posting as Exhibit #3.  Assistant City Attorney Farrell submitted the Cost Recovery Sheet in the amount of $411.75 as Exhibit #4.
 
Vice Chairman Bell made a motion that the Board issue the following Finding of Fact in Case # 16-81, relating to the Defendant, Rodney A Brooks & Wanda G Brooks:
  1. That the Defendant was properly notified of the violations as alleged in the complaint.
  2. The Defendant is the owner of, or in possession of, the real property located at 1165 Cleveland Street, Titusville, Florida.
  3. The Defendant is in violation of the following provision of the Code of Ordinances of the City of Titusville:

Giving the Defendant until 12 noon on September 9, 2016 to correct the violations to the written satisfaction of the Code Enforcement Officer or to appear before this Board at City Hall, Titusville, Florida on September 12, 2016 to show cause why the violations have not been corrected and why this Board should not proceed to impose a fine for the violations.

Case #16-86 Rameshwar N Mathur – 2501 Dorothy Circle
Officer Crisco testified he inspected the property on June 7, 2016 and found the violations of Section 13-26 Overgrowth and Section 6-109 Property Maintenance Sub Section 304.3 Premise Identification to exist.  City Attorney Farrell submitted the Notice of Violation and Affidavit of Posting as Exhibit #1.  Officer Crisco testified that as of June 29, 2016 the violation of Section 13-26 Overgrowth was corrected by the owner.  Officer Crisco testified that he re-inspected the property on August 8, 2016 and the property was still in violation of Section 6-109 Property Maintenance Sub Section 304.3 Premise Identification.  Officer Crisco testified that he left three messages for the owner of the property and had not spoken to Mr. Mathur, but the Code Manager had and Mr. Mathur said he would have the violation corrected by the weekend before Code Board.  Assistant City Attorney Farrell submitted three photographs of the property taken August 8, 2016 as Exhibit #2.  Assistant City Attorney Farrell submitted the Notice of Hearing and Complaint and Affidavit of Posting as Exhibit #3.  Assistant City Attorney Farrell submitted the Cost Recovery Sheet in the amount of $411.75 as Exhibit #4.
 
Vice Chairman Bell made a motion that the Board issue the following Finding of Fact in Case # 16-86, relating to the Defendant, Rameshwar N Mathur:
  1. That the Defendant was properly notified of the violation as alleged in the complaint.
  2. The Defendant is the owner of, or in possession of, the real property located at 2501 Dorothy Circle, Titusville, Florida.
  3. The Defendant is in violation of the following provision of the Code of Ordinances of the City of Titusville:

Vice Chairman Bell made a Motion that the Board issue its Order to Correct relating to the Defendant, Rameshwar N Mathur:
  1. Adjudging the Defendant to be in violation of the Sections of the Code of Ordinances of the City of Titusville as determined in the Findings of Fact.
  2. Giving the Defendant until 12 noon on September 9, 2016 to correct the violation to the written satisfaction of the Code Enforcement Officer or to appear before this Board at City Hall, Titusville, Florida on September 12, 2016 to show cause why the violation has not been corrected and why this Board should not proceed to impose a fine for the violation.
  3. The Defendant is ordered to pay $411.75, which represents the costs incurred by the City of Titusville to bring this case before the Board.

Case #16-87 Basil & Dania Itani – 5405 Sandra Drive
Officer Crisco testified he inspected the property on June 7, 2016 and found the violations of Section 13-26 Overgrowth and Section 6-109 Property Maintenance Sub Section 301.3 Vacant Structure and Land to exist.  City Attorney Farrell submitted the Notice of Violation and Affidavit of Posting as Exhibit #1.  Officer Crisco testified that as of July 1, 2016 the violation of Section 13-26 Overgrowth was corrected by the owner.  Officer Crisco testified that he re-inspected the property on August 8, 2016 and the property was still in violation of Section 6-109 Property Maintenance Sub Section 301.3 Vacant Structure and Land.  Officer Crisco testified that he spoke to the owner of the property and Mr. Itani advised he would have the violation corrected over the weekend.  Assistant City Attorney Farrell submitted two photographs of the property taken August 8, 2016 as Exhibit #2.  Assistant City Attorney Farrell submitted the Notice of Hearing and Complaint and Affidavit of Posting as Exhibit #3.  Assistant City Attorney Farrell submitted the Cost Recovery Sheet in the amount of $411.75 as Exhibit #4.
 
Member Moniz made a motion that the Board issue the following Finding of Fact in Case # 16-87, relating to the Defendants, Basil & Dania Itani:
  1. That the Defendants were properly notified of the violation as alleged in the complaint.
  2. The Defendant is the owner of, or in possession of, the real property located at 5405 Sandra Drive, Titusville, Florida.
  3. The Defendant is in violation of the following provision of the Code of Ordinances of the City of Titusville:
    Member Hillock seconded.  Motion carried by unanimous voice vote. 
 
Member Moniz made a Motion that the Board issue its Order to Correct relating to the Defendant, Basil & Dania Itani:
  1. Adjudging the Defendant to be in violation of the Sections of the Code of Ordinances of the City of Titusville as determined in the Findings of Fact.
  2. Giving the Defendant until 12 noon on September 9, 2016 to correct the violation to the written satisfaction of the Code Enforcement Officer or to appear before this Board at City Hall, Titusville, Florida on September 12, 2016 to show cause why the violation has not been corrected and why this Board should not proceed to impose a fine for the violation.
  3. The Defendant is ordered to pay $411.75, which represents the costs incurred by the City of Titusville to bring this case before the Board.
Member Hillock seconded.  Motion carried by unanimous voice vote.

Assistant City Attorney Farrell advised the Board this case is being withdrawn due to compliance.
 
Case #16-89 Laphon Enterprises LLC – 503 Cheney Highway
Assistant City Attorney Farrell advised the Board the City would like to continue this case until the September 12, 2016 Board meeting.
 
Member Myers made a motion to continue Case #16-76 until the September 12, 2016 Board meeting.  Member Hillock seconded.  Motion carried by unanimous voice vote.
